PRIVACY AND COOKIE POLICY

Realting LLC respects and honors the privacy rights of its Users. Below you will find information about what User data we collect and process on the Realting.com platform, the purpose for which we do so and how we ensure the protection of User data. By using Realting.com, the User acknowledges that he/she has fully read, understood and agreed to abide by all the terms and conditions set out in this Privacy and Cookie Policy.

§ 1.

Definitions

The following expressions used in the text of the Privacy and Cookie Policy have the following meanings:

  1. Administrator – LLC “REALTING” with registered office in Warsaw, 28/02.53 Zygmunta Volga Street, 02-963 Warsaw, entered in the Register of Entrepreneurs maintained by the District Court of the Capital of Warsaw in Warsaw, 13th Commercial Branch of the National Court Register, under No.: 0001097010, NIP: 9512593048, REGON: 528201474, represented by: Alena Martynienka - President of the Management Board.

  2. Personal Data – any information relating to an identified or identifiable individual using Realting.com (directly or indirectly), and information that can be linked to an identified or reasonably identifiable individual.

  3. Account – a set of information stored in the Realting.com IT system relating to a specific User, which requires a Login and Password for access.

  4. Password – a sequence of alphanumeric characters required to identify the User when accessing the Account.

  5. Login – user's e-mail address used in the process of registration and use of the Account.

  6. Privacy and Cookie Policy – a document defining the purposes and principles of data collection of LLC “REALTING”, necessary for the provision of services by the Administrator, as well as storage and access to information on the User's devices with the help of cookies, used for the provision of services in electronic form by the Administrator.

  7. Rules and Regulations – rules and regulations for the provision of services in electronic form, located at: https://realting.com/info/terms-of-use-pl.

  8. Realting.com – an overseas real estate platform connecting buyers and sellers from all corners of the world. It is a comprehensive and high quality product aimed at facilitating international real estate transactions. The main goal of the platform is to make the global real estate market more accessible, safe and efficient for all its participants. On Realting.com users can find real estate listings, a detailed database of real estate from more than 80 countries and an affiliate sales system for platform members. Additional Realting.com services include lead generation, banner advertising, promotional article writing and webinars. Through these activities, users increase the visibility of properties for sale, attract interested buyers and gain an edge in the competitive global real estate market. The platform is available under the domain www.realting.com.

  9. Services – services provided by the Administrator through the Realting.com platform, specified in the Rules.

  10. User – a person using the Administrator's Services through the Realting.com platform, being a natural person, legal entity, including as a professional entity (broker, agent, agency), who is obliged to comply with the Rules.

§ 2.

Personal data for registering a user account

  1. In order to register on Realting.com, the following data must be provided:
    - e-mail address;
    - password.

  2. All personal data are collected, stored and processed by LLC “REALTING” with its registered office in Warsaw in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (Official Journal of the EU.L No. 119, p. 1), the provision of personal data is voluntary. 

  3. The provided data is protected from access by third parties and is used by the Administrator to improve the quality and convenience of services and provide correct service to users. The Administrator processes the information to improve, test and monitor the efficiency of the services, identify technical failures and problems related to the operation, protection and optimization of the Realting.com platform.

§ 3.

Processor of personal data

Users' personal data is processed by the Administrator providing services via the Realting.com platform, the operation of which is described in detail in § 1 point 8.

§ 4.

Scope and purpose of the processing of personal data

  1. Personal data are collected, stored and used by the Administrator with the voluntary consent of the Users to whom they relate, in accordance with the law, in compliance with proper procedures and in a manner that guarantees their security. 

  2. The provision of personal data by the User is voluntary, but necessary for the use of those services provided electronically by the Administrator, which require the provision of personal data. 

  3. The Administrator may process personal data for the purposes of:
    - registration and identification of Users on the platform;
    - creation of the User's personal account on the platform;
    - creating a profile of a professional participant of the real estate market with the data of its employees;
    - placement of advertisements (provision of services to Users on a contractual basis);
    - moderation of listings;
    - submission of advertisements through MLS.REALT;
    - use the platform to send messages (communications) through Users' personal accounts on the Realting.com platform;
    - to ensure the display of data about the application in the personal offices of Users on the platform;
    - to receive from the User an application for an object/real estate in order to place an advertisement on the platform;
    - to send notifications to the Users who have left an application for a real estate object related to its placement on the Realting.com platform;
    - storing and displaying on the Realting.com platform the application left by a Platform User, in order to allow Platform Users to interact with the person who left the application regarding the real estate object;
    - sending informational messages (related to the provision of services);
    - conducting direct advertising mailings;
    - processing appeals;
    - contacting the support service;
    - using personal data on the Realting.com platform, in the social networks of the Organization (Facebook, Instagram).

  4. Collection, processing and storage of the following User data:
    - name, surname, patronymic (if the User has one);
    - approximate information about the physical location (country, region, city);
    - residential address (place of residence);
    - delivery address (if it differs from the address of residence);
    - electronic mail (e-mail) address;
    - telephone number;
    - information about the Internet browser used, the version of the Internet browser;
    - full IP address;
    - User's image;
    - information about payments;
    - profession (professional experience, specialization);
    - professional data (registration number of the realtor's license, number of the realtor's card, other similar data for foreign participants of the real estate market);
    - links to profiles in various social networks;
    - data placed by the User in advertisements;
    - password for logging in;
    - the essence of the appeal, other personal data specified by the subject in the appeal;
    - other voluntarily provided personal data.

  5. Personal data is processed only during the period of rendering services by LLC “REALTING” or fulfillment of obligations stipulated by law.

§ 5.

The right to access, rectify and delete the content of one's personal data

  1. The user has the right to:
    - withdraw consent to the processing of personal data;
    - access to their personal data;
    - correction (modification) of their personal data;
    - deletion of personal data (“right to be forgotten”);
    - restriction of personal data processing;
    - transfer of data to another personal data processor. 

  2. Any person who has given consent to the processing of his/her personal data in the context of the use of the services, applications available on the realting.com website may submit a corresponding request in one of the following ways: 

  3. by sending a corresponding e-mail message of refusal to process personal data to the Administrator's e-mail address: info@realting.com.

  4. by sending the opt-out request by registered mail to the following address: LLC “REALTING” with registered office in Warsaw, 28/02.53 Zygmunta Volga St., 02-963 Warsaw.

§ 6.

Complaint to the supervisory authority

Any complaints related to the processing of personal data may be filed with the supervisory authority, which as of the date of this document is the Office for Personal Data Protection, 2 Stawki Street, 00-193 Warsaw.

§ 7.

Disclosure of personal data

  1. The Administrator does not transfer - does not sell or provide in any way - the collected personal data of Users to third parties other than the Administrator and the organizations mentioned in the following paragraph. 

  2. Users' personal data may be entrusted on the basis of separate agreements on entrusting the processing of personal data to organizations processing data on behalf of the Administrator, participating in the provision of services offered by the Administrator:
    - those operating the Administrator's ICT systems or providing ICT tools;
    - persons providing consulting, advisory, auditing, legal, tax, accounting services on behalf of the Administrator;
    - other organizations cooperating with the Administrator. 

  3. When transferring personal data to the above organizations, the Administrator requires from a particular organization to observe confidentiality and security of information, as well as the application of the level of protection of processed personal data not lower than the level provided by the Administrator.

  4. The Administrator may decide to transfer data outside the European Economic Area only to the extent permitted by law.

§ 8.

Cookies

  1. The website automatically collects information contained in cookies. Cookies (so-called “cookies”) are computer data, in particular text files, which are stored on the User's end device Realting.com (e.g. computer, phone, other equipment, including mobile devices) and are intended for the use of websites and allow the information contained therein to be read only by the server that created them.

  2. The Administrator may use cookies for the purposes of: 
    - adapting the content of the Realting.com websites to the User's preferences and optimizing the use of the websites; in particular, these files allow Realting.com to recognize the device of the User of Realting.com and display the website accordingly, adapted to his/her individual needs;
    - creating statistics that help to understand how Realting.com Users use the Websites, thus improving their structure and content;
    - maintaining the Realting.com User's session (after logging into the website), so that the User does not have to re-enter the Login and Password on each sub-page;
    - memorizing interactions, such as answering online surveys;
    - provide the User with promotional content more relevant to their interests.

  3. Realting.com uses two main types of cookies:
    - session cookies, which are temporary cookies stored on the User's terminal equipment until the User logs out, leaves the site or turns off the software (web browser); 
    - persistent cookies, which are permanent cookies that are stored on the User's terminal equipment for the time specified in the cookie parameters or until they are deleted by the User. 

  4. Regarding the purpose of the use of cookies, Realting.com may use the following types of cookies: 
    - cookies necessary for the use of the services available on Realting.com, such as authentication cookies used for services that require authentication; 
    - security cookies, such as those used to detect misuse of authentication;
    - cookies that allow the collection of information about the use of Realting.com websites;
    - functional cookies that allow to “remember” the settings selected by the user and personalize the interface, for example, with regard to the selected language or region of origin of the user, font size, appearance of the site,statistical cookies, used to collect site statistics,
    - advertising cookies, which allow to deliver to the User advertising content more relevant to their interests.

  5. The user may consent to the storage of cookies from Realting.com on his terminal device through the settings of the software installed on the telecommunications terminal device he uses. 

  6. The default web browsing software (web browser) allows cookies to be stored on the User's terminal device.

  7. Users of Realting.com may change their cookie settings at any time. 

  8. These settings can be modified, in particular in such a way as to block the automatic processing of cookies in the web browser settings or to inform them each time they are placed on the User's device. 

  9. Detailed information on the possibility and methods of processing cookies is available in the settings of the software (web browser). Restrictions on the use of cookies may affect some functionalities available on Realting.com.

§ 9.

Final provisions

  1. The Privacy and Cookie Policy is effective as of 01/07/24.

  2. The contents of the Privacy and Cookie Policy are made available to the Users of Realting.com free of charge on https://realting.com/info/privacy-policy-pl in such a way that the User can, before using Realting.com, retrieve, reproduce, record and store the contents of the document by means of the information and communication system used by the User.

  3. The Administrator has the right to block access to the Realting.com website or parts thereof for important reasons, including, in particular, in the event of any irregularities in use or the occurrence of circumstances that may be detrimental to the User or the Administrator.

  4. In the event that individual provisions of the Privacy and Cookie Policy are found to be invalid or ineffective, the invalidity or ineffectiveness of this provision does not affect the validity or effectiveness of the remaining provisions. The Administrator will endeavor to replace the invalid or ineffective provisions with a new legally valid provision.

  5. With respect to the information presented on the Realting.com website, posted on it or provided by third parties, the Administrator is not responsible for the truthfulness, accuracy and completeness of such information, as well as for its usefulness for any activity of the User.

  6. The Administrator is not responsible for the User's use of the site Realting.com in violation of the provisions of the Privacy and Cookie Policy, the provisions of the Terms of Use, applicable law or the provisions of agreements in force between the Administrator and the User.

  7. The User is responsible for any consequences of the User's incorrect filling out of the forms available on Realting.com, in particular, for providing incorrect or false data.

  8. The provisions of the Privacy and Cookie Policy do not affect the ability of Users who are consumers to invoke the mandatory provisions of the law governing consumer protection.

  9. In matters not covered by the Privacy and Cookie Policy, the provisions of Polish law, including the Act of April 23, 1964. - Civil Code and the Act of July 18, 2002 on the provision of electronic services, as well as other applicable provisions of Polish law.

  10. Any disputes arising from the interpretation or application of the Privacy and Cookie Policy shall be resolved by the court having jurisdiction over the Administrator's registered office in accordance with the laws applicable to the Administrator.

  11. Administrator reserves the right to make changes to the Privacy and Cookie Policy. Changes will be published on Realting.com at least 7 days before they take effect.

  12. This Privacy and Cookie Policy supersedes all previous provisions regarding privacy and cookie policy.
